Basin Media – Terms of Service
By booking services with Basin Media (“Photographer”), the client (“Client”) affirmatively agrees to the following Terms of Service. This agreement is binding upon booking.
Travel & Mileage
Basin Media includes up to 20 miles of travel at no charge, measured one-way from the Believe’ sign in Reno, Nevada.
For properties beyond this distance, travel is billed at $2.50 per additional mile, calculated using the one-way distance.
This rate includes round-trip travel and covers all travel time, fuel, and vehicle costs.
Mileage fees may be added to the final invoice and apply to return visits when applicable.
Cancellations & Return Visits
- Cancellations within 2 hours of the scheduled appointment may incur a $50 fee
- Return visits required due to property not being ready, access issues, or incomplete preparation may incur a $50 service fee
Weather-related rescheduling may be waived at Basin Media’s discretion.
Payments & Processing Fees
Payment is due upon delivery of media unless otherwise agreed to in writing.
A 3% processing fee applies to payments made via credit card, debit card, or online payment processors. This fee reflects the transaction costs charged by financial institutions and payment platforms.
Clients may avoid this processing fee by paying via cash, check, or Zelle.
Invoices not paid within a reasonable time after delivery may be subject to additional fees, service suspension, or copyright enforcement. All services rendered remain payable regardless of listing status.
Returned checks may incur a $35 returned payment fee, and payment must be resolved before media licensing remains valid.
Copyright & Licensing
Basin Media retains full copyright ownership of all photos, videos, and media created.
The Client is granted a non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property photographed while it is actively listed for sale.
This license:
- Does not transfer to future listings, agents, owners, or brokerages
- Does not permit use for short-term rentals unless explicitly booked for that purpose
Personal branding use (personal websites and electronic advertisements) is permitted as a courtesy.
Printed publications or third-party use require prior written approval and compensation.
Unauthorized Use & Liquidated Damages
Clients may not sell, share, transfer, sublicense, or allow third-party use of any media, including reuse by new agents after a listing expires, is canceled, or sold.
Unauthorized use constitutes copyright infringement and may result in liquidated damages based on current Basin Media pricing, in addition to any other remedies available under law.
Edits & Accuracy
Clients may not digitally alter or edit any delivered media without written permission from Basin Media.
Any requested edits that may mislead or deceive consumers — including but not limited to sky replacement, virtual twilight, or grass enhancement — are used at the Client’s discretion. Basin Media assumes no liability for how edited media is presented or interpreted.
Property Condition & Access
Properties are photographed as-is.
Clients are responsible for ensuring the property is clean, staged, and accessible at the scheduled time. Basin Media does not provide cleaning, staging, decluttering, or landscaping services.
If no authorized representative is present, the Photographer’s professional judgment shall be deemed acceptable.
Quality Guarantee
Reasonable re-editing for quality issues directly attributable to Basin Media will be provided at no charge.
Return visits or additional work requested for reasons not caused by Basin Media may incur additional fees.
If the Client requests and receives a full refund within 7 days of delivery (and the listing is not under contract), all licensing rights are void and the Client must delete and discontinue use of all delivered media.
Delivery & Storage
Typical delivery timelines:
- Photos: within 24-48 hours
- Larger or specialty shoots: up to 48 hours
- Video services: up to 4 business days
Weekend shoots (Saturday or Sunday) are delivered on the following Monday
Media access is maintained for 120 days after delivery. Long-term storage is not guaranteed.
Aerial / Drone Services
All aerial services comply with FAA regulations and are subject to airspace authorization, weather, and safety conditions.
If drone services cannot be completed due to authorization or safety restrictions, the aerial portion will be removed from the invoice or refunded.
Right to Refuse Service
Basin Media reserves the right to refuse or terminate service for non-payment, unreasonable requests, poor communication, or unprofessional conduct.
Agreement & Acceptance
By booking services and checking the acceptance box, the Client acknowledges they have read, understood, and agreed to these Terms of Service.
